And those of us who didn't won't be able to use it any more, right (even with no updates)? You need to clarify that then when people register. I understood that the program would still work without updates when version 5 was released. It just wouldn't have the most current db updates.

When I purchased Ad Muncher in 2004, your website stated:

Based upon this statement, your new policy to begin charging PREVIOUS customers a yearly fee is in violation of the TOS at the time of purchase.

You need to pay more attention. This only applies to new licenses.

Old licenses are grandfathered in. We've stated as such many times.

Looking at the comments in this thread would suggest that you are the one who's not being clear.

You have stated that previously paid customers will have a "lifetime" license for v4, but will have to pay to upgrade to v5 and subsequent list updates. This is NOT the same policy (..covers you for life (no monthly or yearly subscription fees); ..allows you to use all current and future versions of Ad Muncher without restrictions) as was stated when many of us made our purchase. Under that policy, I purchased Ad Muncher "for life" with no need for additional fees of any kind.

Rather than answering individual questions, maybe it would be beneficial to everyone to have a FAQ or "upgrade chart". It sounds like you've made multiple changes your licensing policy (users before v4.8, users after v4.8 but before v5, new users) that affects different people in different ways.

I think we all understand the current policy for new paid users -- we just don't understand how this impacts your past supporters.

My what a lot of confusion! I thought the situation was quite clear. I'm wondering if the phrase 'grandfathering in' is not being fully understood? I myself have what is now called an old licence. I forget when I first bought it but probably five years ago. Therefore I am not expecting Jeff and Murray to require a further fee from me when v5.0 is available for upgrade, nor for definitions or future versions or upgrades, as they've categorically stated that we with old licences are grandfathered in. The old licence is effectively a lifetime licence.
However in view of the confusion, Jeff and Murray, I think an FAQ about licences and fees might be worthwhile.

Their answer to my question is probably the start of (my) confusion:

ME: I realize that users who've purchased version 4.x will have lifetime access to the program, and won't need to upgrade to 5. However, will a 4.x user still get list updates for life?

THEM: Of course not. v5.x will support regex and many new filtering categories. The list formats are completely different.

So this implies that I can use v4 for life, but have to pay for the v5 upgrade as well as yearly list updates.

This is very simple.

Whatever license you purchased from us remains in force now.

If you purchased a v4.x license then obviously v5.x won't be a free update.

But you are free to use v4.x indefinitely.

List updates can't continue because of the changes to v5.x

It's always been this way from the day we changed to version based licenses, that has never changed.

What's "very simple" is that you're trying to charge people for something you already promised them when they paid you the first time.

You CANNOT charge us for upgrading to v5. You CANNOT charge us for receiving list updates so that we have an operating product. "..all current and future versions without restriction".

I spoke with Jeff over IRC and got everything straightened out, so I wanted to give everyone an update.

Jeff's strengths are definitely in programming and not comprehending the English language (just kidding, Jeff!). He didn't see the parts where I said "When I purchased AM in 2004" or pasting the TOS of my license (hehe!), so he thought I recently purchased a license. For anyone who paid prior to around 2006, you have lifetime program and list updates. You won't need to pay for v5, or anything else..

Your best bet would be to go http://www.admuncher.com/reglookup.shtml and it will email you the type of license you have.

And strangely.. he's a pretty decent guy after all. ;)

If you purchased your license after October 2006 then yes, the only v5.x license that you can upgrade to is a yearly one.

Only life time licenses are exempt from this. for obvious reasons.

It was always this way. Your first year will be discounted of course.

You can of course choose to use v4.x indefinitely.

The date is irrelevant, what matters is what license you actually have.

Which it tells you. so I don't see a need for a change.

And your conclusion was wrong, "until v5.0 is released", that means you'll have to purchase the update.

What do you mean the date is irrelevant? "After October 2006" is very mis-leading if he purchased it during October 2006.

That was just an estimate.

What actually matters is the license you have.

The one you have is the one you've always had.

The only way to know for sure which you have is to use the above 2 methods.
